Private Client Agreement & Terms of Service

Effective Date: 03.12.2025

Applicability: These terms apply specifically to all 1:1 Private Coaching, Mentoring, and Consulting engagements with Andreas Manole (Invictus Self).

By purchasing a Pathway (such as The Catalyst, The Foundation, The Immersion, or The Mastery), you agree to enter into a professional partnership governed by the following terms.

1. SCOPE OF PRACTICE & MEDICAL DISCLAIMER

1.1. Coaching vs. Therapy

You acknowledge that Andreas Manole provides coaching, mentoring, and somatic guidance. While this work is trauma-informed and focuses on nervous system capacity and regulation, it is not a substitute for clinical psychotherapy, psychiatric intervention, or medical treatment.

1.2. No Diagnosis

Invictus Self does not diagnose, treat, or cure mental health disorders. If you are currently under the care of a psychiatrist or mental health professional, we recommend you inform them of your participation in this coaching work.

1.3. Crisis Protocol & MHFA Status

Andreas Manole is a qualified Mental Health First Aider. While I am trained to identify signs of distress and provide initial supportive triage during our sessions, this coaching engagement is not an emergency service. If you are in active crisis or feel you are a danger to yourself or others outside of a session, you agree to contact emergency services (999 or 111) immediately.

2. COMMITMENT & CANCELLATION POLICIES

To ensure the integrity of the container, the following specific rules apply to each Pathway:

2.1. The Catalyst (Single Session)

2.1.1. Rescheduling: You may reschedule your session up to 24 hours in advance via the confirmation link.

2.1.2. Cancellations: Sessions cancelled with less than 24 hours’ notice are non-refundable.

2.2. The Foundation (Monthly Retainer)

2.2.1. Minimum Commitment: This Pathway requires a strictly non-cancellable minimum commitment of 3 months (90 days). This duration is necessary to honour the physiological timeline of neuroplasticity and behavioural change.

2.2.2. Cancellation: Following the initial 3-month period, the agreement becomes a rolling monthly contract. You may cancel at any time via your account on the Invictus Self Learning Platform. Cancellations must be processed before your next billing date. No partial refunds are issued for mid-cycle cancellations.

2.3. The Immersion (Deep Dive Retainer)

2.3.1. Structure: This is a rolling monthly agreement with no long-term lock-in.

2.3.2. Downgrading: You may downgrade to The Foundation ahead of any new billing cycle via the Platform.

2.3.3. Cancellation: You may cancel at any time via the Platform, effective from your next billing date.

2.4. The Mastery Protocol (Annual Access)

2.4.1. Validity: All 20 sessions must be booked and utilised within 12 months of the purchase date.

2.4.2. Expiration: Any sessions remaining after the 12-month period will expire. They do not roll over and are not refundable or transferable. This policy exists because capacity has been explicitly reserved for you for the duration of the term.

3. SCHEDULING & ATTENDANCE

3.1. The ‘Integration Week’ Policy

My work operates in cycles of action and rest. For all monthly retainers (Foundation and Immersion), the fee covers 4 sessions per calendar month.

In months containing 5 weeks, the 5th week is designated as an “Integration Week.” There will be no session during this week. The monthly fee remains fixed regardless of the number of weeks in the month, as it covers the container of support, not an hourly wage.

3.2. 24-Hour Notice Rule

Consistency is key to this work. If you need to reschedule a session, you must do so via the calendar link at least 24 hours in advance.

  • Exceptions are made only for genuine emergencies, at the discretion of Invictus Self.
  • Sessions cancelled or rescheduled with less than 24 hours’ notice are forfeited and count towards your package allowance.

3.3. Lateness

Andreas Manole will wait for 15 minutes past the start time of our scheduled session. If you have not arrived by this time, the session is considered a ‘No Show’ and is forfeited.

4. CONFIDENTIALITY & PRIVACY

4.1. Strict Confidentiality

Unlike our group workshops, 1:1 coaching sessions are strictly confidential. I will not share the content of our sessions, your identity, or your personal details with any third party without your explicit, written consent, unless required by law (e.g., risk of harm to self or others).

4.2. No Recordings

To create a safe space for deep work, private sessions are not video recorded by default. You may request to record a session for your own personal use, but you may not share, publish, or distribute this recording.

5. DATA PROTECTION & SECURITY (UK GDPR)

5.1. High-Level Security Standards

Invictus Self is fully compliant with the UK Data Protection Act 2018 and UK GDPR. We recognise the sensitive nature of the information shared in a private coaching container. Therefore, we invest in enterprise-grade cybersecurity to protect your data.

  • Infrastructure: All client records and notes are stored using encrypted cloud solutions.
  • Protection: We utilise premium antivirus protection and secure VPN protocols (Bitdefender) to safeguard against unauthorised access and cyber threats.

5.2. Your Rights

As the Data Controller, Andreas Manole ensures your data is processed lawfully and transparently. You have the right to request access to your records or request their deletion at any time, subject to legal retention requirements.

6. COMMUNICATION BOUNDARIES

6.1. WhatsApp/Text Support

For Pathways that include integration support (Immersion and Mastery), I am available for brief check-ins and integration insights via WhatsApp.

  • Scope: This channel is for coaching support, sharing wins, or brief clarifications. It is not a channel for deep processing, trauma dumping, or crisis management. If a topic requires detailed discussion, please book a session.
  • Response Time: I aim to respond within 24 hours (Mon-Fri).

7. PAYMENT & REFUNDS

7.1. No Refunds on Retainers

Due to the high-touch nature of this work and the reservation of space in the calendar, all retainer payments are non-refundable once the billing cycle has commenced.

7.2. Failed Payments

If a subscription payment fails, you will be notified immediately. Access to the Invictus Self Learning Platform and the booking calendar will be paused until the balance is cleared.

Invictus Self reserves the right to terminate a coaching engagement immediately if:

  • The scope of the client’s needs exceeds the professional capacity of a coach (e.g., acute psychiatric need).
  • The client is consistently abusive, aggressive, or disrespectful.
  • The client repeatedly violates the boundaries outlined in this agreement.

In the event of termination by Invictus Self due to scope of practice issues, a pro-rata refund for unused services may be issued. In the event of termination due to abusive behaviour, no refund will be issued.
